Hi everyone,
I'm a relatively new member of NJSWF, and a newbie to striper fishing (BTW so  far Fish-7  Jeff-0 ), and I appreciated the welcome and advice I've experienced here! On my fishing forum up here in Long Island, I found out about the situation described below.  Could you take the time to read this(kind of long-with links), and take any action you are up for as soon as possible? If possible, please spread this message/info as much as you can.  Time is of the essence.  The following is written by the administrator of a forum from Montauk, LI and reprinted and distributed with permission.

Last week the international child abduction case of Sean Goldman, the son of David Goldman of Shore Catch Guide Service here in NJ was made public on WABC TV New York (video). On Wednesday the 24th, the story is going national on NBC's Today Show.

While I do not know all the details of this case, I do know David, he is a good friend who has spent every cent he has earned over the last four years paying lawyers here in the US and in Brazil to get his son home. Off the record, I was told by a mutual friend that the situation had become so bad that on a trip to Brazil he was told that it would not be good for his health if he ever returned! In spite of that blatant threat he has never given up.

The case took a sudden and tragic turn recently when his ex-wife died during child birth in Brazil. Now her new husband is demanding custody of David's son.

On Sunday night a small group of David's friends decided that the best and most proactive way we could help David was to put up a web site to coincide with the Today Show feature. Everyone started working on that immediately, I am the "webmaster/editor" and the site is being hosted on my server.

The URL is http://www.bringseanhome.org. Due to some configuration issues with my provider, WestHost, Inc. I am late in getting the URL spread across the internet. You should be able to connect to the URL this afternoon but if not try http://208.131.156.143 - that works!

As you will see it's work in progress but the site along with a Wordpress blog will be finished tonight so we'll be ready on Wednesday when the story goes national on the Today Show.

A MESSAGE FROM DAVID GOLDMAN (THE FATHER IN HIS OWN WORDS)

I, David Goldman, married Bruna Bianchi Caneiro Ribeiro in Eatontown, New Jersey, USA, on
December 17, 1999. We had a son, Sean Goldman, born in Red Bank, NJ on May 25, 2000. On
June 16, 2004, I drove Bruna, Sean and Bruna’s parents to Newark Airport for a planned 2-week
vacation to her parent’s home in Brazil. Bruna arrived in Brazil and called me that day to tell me
our marriage was over, she and Sean were not returning to the US, and if I ever wanted contact
with my son again, I would have to sign custody over to her. I have never signed any papers
granting Bruna custody of our son, Sean.
Prior to Bruna’s (with the aid of her parents) decision to permanently remove Sean from our home
and my life, without my consent, the three of us were living as a family in Tinton Falls, NJ USA.
Prior to Sean’s “abduction”, I was under the impression that our home-life was happy and typical
of any American family’s. Even since the date of Sean’s abduction, Bruna made no allegations to
the contrary, and this is documented in the court records in Brazil and the United States.
I have been fighting in the Brazilian courts under The Hague Treaty for 4+ years. All counts of
the law under The Hague Treaty as well as Brazilian, US and international law are clear and
documented in court records in Brazil and the US that Sean was and still is being retained
illegally and should be returned to the US. The Brazilian courts have ignored these orders as well
as The Hague law and have continually ruled that Sean belonged with his mother and the mother
is the most important bond. They have ruled as if it were a simple custody case, where the
mother always gets the child. During the past 4+ years, I have made many trips to Brazil in the
hope of being reunited with my son. I have been present for all rulings rendered by Brazilian
courts, yet have never been permitted to see Sean. At the Superior Court level in Brazil, Bruna
was awarded custody by a panel of 5 judges. 3 judges ruled in favor of Bruna, while 2 voted in
favor of me.
Although Bruna and I are still legally married in the United States, Bruna obtained a divorce in the
eyes of Brazil (without my presence or knowledge). It is my understanding that Bruna became
pregnant and remarried in Brazil within the past year. Bruna married a Jaoa Paulo Lins e Silva,
an attorney in Brazil. He works for his father’s law firm, and they are a very prominent Brazilian
family from what we can tell from internet searches and other sources. The irony of it all is that
both Jaoa Paulo and his father concentrate on “Family Law”, particularly international Family
Law. His father, Paulo Lins e Silva, has even spoken at The Hague regarding child abduction.
On August 22, 2008, Bruna tragically passed away during childbirth. I was not informed of her
death by her parents, nor by her new Brazilian husband. I found out only through the research of
friends in the U.S. Since I am his biological father, and the only other person with a reasonable
claim to custody, I assumed that I would be reunited with Sean and return him to our home in the
U.S. I immediately contacted my Brazilian counsel Ricardo Zamariola Junior 011-55-
1182771001. I also contacted my lawyer in the States, Patricia Apy Esq. 732-219-9000 Red
Bank, Monmouth county NJ. Both attorneys advised me to travel to Brazil as soon as possible. I
traveled to Sao Paulo on Delta flight 121, which arrived in Sao Paulo at approximately 9:40 am 7
September 2008. I traveled to to Brazil with my mother Eleanor Goldman and our family friend,
Anthony Rizzuto. Since learning of Bruna's passing, all attempts to directly contact Sean or
Bruna's family in Brazil have failed. Through my attorney in Brazil, I attempted to set up visitation
with Sean. Via response by their Brazilian counsel, Bruna's Brazilian husband and parents have
denied any contact between Sean and myself or his paternal grandmother.
I have been told by both attorneys that I "should" be able to see and regain custody of Sean.
However, nothing in this case has ever gone as it "should" under Brazilian and/or international
law. Worse still, recent events in Brazil have given us greater cause for concern and have
reinforced our beliefs that the corruption / bias in Brazilian legal system could prevent justice from
ever being served. Soon after our arrival in Sao Paulo, we learned that Bruna's Brazilian
husband did not file for custody of Sean. Instead, he filed to replace me (his biological father) on
a birth certificate issued for Sean in Brazil. My lawyer has stated this is clearly an invalid
application of Brazilian law. However, the only assurance he could provide regarding the
potential outcome of this action was that it "should" not be successful.
I am engaged in a battle to regain custody of my son, who needs me more now than ever.
Unfortunately, I am fighting against people with substantial influence at high levels in the Brazilian
judiciary system, government and media. It is imperative for my success that I have high level
support within the government and media of my own country. I need this now more then ever. I
find it impossible to believe that the United States will passively allow the child of a U.S. citizen to
be abducted and naturalized to another country.
So now after four years of trying desperately to be with my son, I find myself sitting in a hotel
room in Sao Paulo since September 7, hoping and praying to reunited with my son, ready to bring
him home and resume our life as father and son. We have much healing to do. I have never lost
hope the day would come for us to be together again. I will never give up, but I need help.

That is really messed up!  How come no one can help this guy.  No one in the police department of his local town, the State Police, the FBI or any politicians??  Pretty messed up how our governments don't stand behind us!  He certainly has the right approach and attitude to just try and get it done himself.  Good luck to him!

You know if this was the other way around and dad fled to the US, the government would turn him over in a heart beat.  Our government would also turn him over if he ever breaks any laws getting his son back now!  Really screwed up and one more reason that I have a "vote of no confidence" for our current government and politicians nosmly!

I paypaled my donation already to help defray Capt. Dave's enormous costs.  The problem with the gov't intervention is politics, Brazil is depended upon for a bunch of political reasons. Publicizing this story and EMing our local politicians will keep the pressure on our Gov't to pressure Brazil to do the right thing.  Anyone have any connections with McCain or Obama?  Feel free to cut and paste my original message to spread the word!  Maybe we can help make a difference.  Thanks everyone!

Anyone know if they are doing any type of fundraising...which at the same time will educate more people, get more support and put some pressure on the politicians and government??

Looks like pressure is on, and Frank Lautenberg and Rush Holt has spoke with the the U.S. Ambassador to Brazil.  Letters and EM's still need to to be sent to keep the U.S. Gov't on top of this.  Time is ticking away!

We have received an electronic copy of a letter from The Special Secretariat for Human Rights of the Presidency of the Republic of Brazil.

The last paragraph states:
“From the point of view of the Secretariat for Human Rights, as the biological father exercises the legal custody of the child in the United States, the establishment of temporary custody rights in Brazil on behalf of the step father violates  the Hague Convention. For this reason, the Secretariat sent a formal message to the National Council of Justice to manifest its concern with the conduction of the case by the local Family court.”

While that sounds very positive, not being fully knowledgeable with the Brazilian judicial system we can only wonder how long the process will take,  appeals filed, delays granted, more appeals...

Here's the latest from the website update.
The Brazilian Fed. Court had ordered visitation a few weeks ago, but the ex-wife's 2nd husband took off with David's son in clear violation of the court order!

David returned from Brazil earlier this week and unfortunately still has not been able to see Sean. We remain hopeful that day will come soon. David will never give up and neither will we in our efforts to bring Sean home. More to follow soon.

Thanks Rod!  That is great.  I read some of the update and it looks like the entire campaign is getting more publicity locally, nationally and internationally!  Capt Dave is slated to be on Dr Phil which is airing December 1st.  That should get the news flowing.

Just watched Capt Dave Goldman on Dr Phil!  The story hasn't changed and it isn't any better, but he got his story out there and got some international publicity from the show.  The story left Dr Phil speechless...not something that happens too often!

The entire Dr Phil show was about parental abduction.  All the stories were just crazy!  Horrible...

It's been on all the TV and print news!
The Brazilian Court finally relented under pressure from our gov't reps, most recently Hilary Clinton of all people, and rendered a court decision ordering the stepfather to return Sean to his Dad, Capt. Dave Goldman of NJ.  I believe they will be reunited Wednesday and return back to the USA shortly!  It took years but Capt. Dave never gave up his struggle.
I hope to meet him one day and wet a line together!

I heard it on the radio today on the way to work.  What GREAT news!!  Finally, what should have happened years ago, will occur sometime tomorrow.  Thankfully, this has a presumptive, happy ending.  Best wishes for a safe reunification and trip back home.  Thank God he got his son back.

Another Brazilian Supreme Court Judge blocked the order and ruled that Sean remain with his stepfather and maternal grandparents.  They have allowed visitations and there was a motion that Sean be allowed to live with his father when he is in Brazil...and that was also reversed by another judge rgmn rgmn!  It is just ridiculous, but at least the issue has the media and political attention it needs!

Thing that gets me is, the maternal grandparents who helped abduct Sean 5+ years ago, appeared on Good Morning America, I believe...pleading their side of the story and saying Sean is better to be left in Brazil since that is all he knows nts nts!  What should have happened, was...the FBI or NYPD should have taken the grandparents into custody for kidnapping.  I bet Sean would have been returned real quickly if that had happened.

I have read that there is some type of abuse going on in the household where Sean is living so, the situation is not great, but, hopefully, will only get better.

Yes, it is extremely frustrating!  And that's a great point about charging the maternal grandparents with custodial interference and/or kidnapping! The Brazilian gov't has another public relations fiasco to contend with, and that is dropping their investigation into that boxer's death without any explanation.
I hope our gov't officials keep the pressure on to at least grant visitation for Capt. David. I can't see any legal reason to stop insanity, but then again, the Brazilian Courts/Gov't are either corrupt or protectionist.  Reminds me of the stonewalling in Aruba of the Halloway matter.

Our government needs to sew on a set of balls and get on top of this. They need to get the youngster back NOW...and on OUR terms. That is the only way this will be resolved to a good conclusion. The Brazilian courts are more corrupt that a Jersey politician.

And Sean is not the only child that is there by illegal means. This country needs to do more for our own people. nosmly

One of the craziest things is...there are plenty of Brazilian Citizens Supporting this cause.  They know how bad and corrupt their government is.  There are several other children that have been taken from the US and are now being harbored in Brazil >:( rgmn rgmn!

I think the appeal was expected given the past actions of this family, yet Capt. Dave went down to Brazil, and a congressman met him there as a show of support.  This family just won't quit. The logic escapes me, but they are privileged and obviously believe they are above the law.  I myself would have hired people to get Sean out of there and back home, but I guess Dave believed in the judicial system, and hoped that justice would prevail.  I work in the NYS court system, and cannot see any legal standing for that Brazilian family. Hopefully the Brazilian Gov't will not delay Sean's return.  It is a travesty and it's going on for far too long!

Just heard on NJ News that the judge ruled for David Goldman. One step closer to getting Sean home where he belongs.

Hopefully, mother's family will not file another appeal and if they do the court immediately shoots it down.

I will be much relieved when he lands on American Soil!!

They act as though they will never see Sean again.  Mr Goldman has already said he would never do to Sean or his Brazilian Family what they had done to Sean and David.  He made it well known they will be able to see Sean.  Probably on American Soil and highly guarded, but, that's what happens when you abduct a child.

Not that it matters, as the important thing was that Sean was returned to David, but how come no criminal consequences came out of this case...he was still abducted and the grandparents were listed as suspects and accessories to the crime 5hrug.

Now on to the more than 2800 other children that have been kidnapped and being held in foreign countries....

I'm just waiting for the update that they are actually on a plane heading home!
It will be a major change and adjustment for Sean, but kids are resilient and smart, and he will realize not only that he's "Home", but will one day understand the truth about what transpired.
I will be tipping a glass or two in sharing Capt. Dave's joy and dream come true during this holiday week!!

What a great holiday for Capt Dave!

Praying for a safe trip home and for a smooth transition for Sean.  It will be a hard adjustment and probably upsetting for him to be without the only family he knows, but he is where he should have been years ago.  He is also still dealing with the death of his mother.

I see the US denied the grandmother to come here to help in the transition.  Although, I think she should be jailed for what she helped her daughter do, it might have been in the best interest for Sean for her to come here and help for a while.

Although the fight for Sean was long and hard, the transition may be just as hard.  Let's keep them in our T&P's...

(CNN) -- A father and son reunited after an international custody battle planned to spend their first holiday season together in five years at Disney World in Florida, a family friend said.

David Goldman and his 9-year-old son, Sean, arrived at Orlando International Airport just after 6 p.m. Thursday after meeting earlier at the U.S. Consulate in Rio de Janeiro, Brazil.

Sean Goldman had been living in Brazil since 2004 when his mother, Bruna Bianchi, took him to Rio de Janeiro for what was to have been a two-week vacation. She never returned, instead remarrying there and retaining custody of Sean. She died last year in childbirth.

The Goldmans will spend their first holiday season together in five years at Disney World, a family friend told CNN.

I had a rotten Christmas Eve, now thinking of ending my relationship with my GF of 6 years, but the news that Dave is back in the US with Sean, has eased my pain! This has been a long and difficult journey!
And BTW, I agree, the maternal Grandparent and the Brazilian Step-father and their families deserve no empathy whatsoever!
The outcome has been a bright spot in my otherwise dreary holiday season!
I wish Capt. Dave and all of you on the NJ Saltwater fishermen forum, the very best in the coming new year!

irenegade, keep your chin up. Sometimes these things with the other half are just not meant to be. Better to find out now then when it is too late. Perhaps things will mend between you and your girlfriend but if they don't, you will find another. As you saw, things finally worked out for Dave and Sean. Things will work for you also.

As far as sympathy for the Brazilian family...these people brought this on themselves. They had no sympathy for Dave or Sean when they deprived them of five years of companionship.

Anyway, I seem to recall one report saying Capt. Dave brought Sean to Disneyworld!

At this point I don't think it would matter one bit what the Brazilian court rules. The US court ruled that custody was given to David Goldman years ago. That is all that would be needed to keep him in this country.

That, along with the fact the a nine year old has no say in who should have custody of him/her, should be enough to end this nonsense with the Brazilian family.
