Got an interesting email from my marina
« on: November 07, 2012, 03:16:30 PM »
Not gonna name names, but basically my marina is floating some pretty harsh accusations at another one across the street.  Allegedly, the "other" marina will not let my marina on their property to remove boats of theirs that floated over.....until that "other" marina puts the boats up on their own blocks and collects salvage fees.  Then they will allow my marina to go over and salvage the boat from them which results in double salvage fees charged to the insured (or god forbid uninsured!!)  You're talking $100 a foot, charged twice by two marinas.   smk

Ridiculous rgmn!  I don't know the legality, but I would say that falls under something that needs to be reported to the NJ Consumer Affairs!

If it's not illegal, it's certainly unethical.  The owner of that other marina sounds like a real jackass! smk

I think that's where it lies.  The insurance companies are actually paying it out without much resistance accourding to the email.  Their response was just as you said, unethical but still not necessarily illegal.

I heard the same. If he HAD to move and block the boats for a legit reason I can see him getting paid for his service. Just to do it so he can collect a fee I would have a major problem with it if it was my boat involved. And then he would have a major problem with me.

Completely agree.  I'll even go so far as to say if the boat is upside down or in a precarious position, then I would agree the offending marina would have the right to move the boat to blocks simply for liability reasons.  If Marina B comes on their property, tries to remove a boat that's in a precarious position and drops it/damages something else then you have liability issues.  But from what I'm hearing this is a situation of boats that are both upright on land in the larking lot that can easily be picked up and moved via forklift, or even worse some of the boat that drifted across the creek and are floating upright and can simply be towed back over.
