Insurance question?
« on: November 08, 2012, 04:09:55 PM »
I bring my wave runner to get serviced and winterized before the storm. I call to check on it and they say that they haven't looked for it yet because they just got the boats in they yard back on blocks. They tell me to call my insurance to open a claim.  I was like, shouldn't your place be responsible for it?   They said no. Now, my Toms River house received no damage so if I had it there, it would have been safe.  Im pissed.  They had my machine, they should be responsible for it.  Correct?   Any thoughts?

That's a tough one..  and sucks.. I don't think they would be responsible for it..

As if I lost my boat.. my marina wouldn't be..

You could try filing a Liability Claim with their insurance carrier.....Problem with that is, 3rd party claims are usually settled at a depreciated amount (Actual Cash Value).......and or you may need to prove negligence on the marinas part.....That may be even tougher.

Kind of like leaving your car overnight at a garage.....If it gets broken into or vandalized it's not the garage's fault or responsibility.

I don't think they are responsible Nick

You could always tell your ins co it floated out of your yard and put the claim in with your ins co

Thats what I am gonna keep my fingers crossed on....good luck with everything. We're here for ya!!!  ;)

Back in the day I am quite sure someone in my neighborhood's shop would claim it on their insurance policy, and receive a fair and equitable fee from their local customer, make the repair and keep all happy. In today's society I think that it is considered a loss. nosmly

Good luck,

Mike

been a while since I insured my boat.  yeah yeah, bad idea. lol. anyway, from what I've been reading from other peoples posts on here and other forums, the marina is not responsible for your boat.  It sucks.  I do remember I had to give information as to where the boat was kept and what type of storage.  So hopefully in that case, it would have helped me if my boat was down there and this happened to me.

If i was storing the boat at the marina, on land or in a slip, I understand that the owner is responsible.  BUT.. if they are doing warrentee work on it and winterizing it, then I personally feel that, they should either cover the loss, or give me the option to move it off their property before the storm, especially since it was on a trailer.. just my $.02

whs  a few days before hurricane floyd hit, I had my quad at the yamaha dealer in Bound Brook.  I do remember getting a call asking if I could pick it up since I live close by.  Also, the quad wasn't insured so I hauled over with the truck and brought it home.  Everything else they had was moved to the top floor.  Not a marina but a similar situation
