Question on Fishing at Ends of Streets

There are several streets in my area that dead-end at a bulkhead.  There are some prime fishing spots in the river at these dead ends.  Problem is, one town has an ordinance prohibiting fishing at these dead end streets.

Doesn't an ordinance prohibit fishing at the end of a dead end street in a river violate the public trust doctrine?

The following linked document from the NJ DEP says towns should:

of public access on land along tidal waterways and their shores"

 Try going to Love Ladies and surf fish. My brother has a place on the bay side. When I go over to the ocean everyone in between wants to know who you are.

It sure does sound like it violates Public Access.  Look at Toms River...you can't fish or crab anywhere along the River or Bay any longer >:(!  Prime bulkheads I used to fish and crab as a kids, but not any longer.  We might block the view or upset the people who own property on the other side of the street.  Complete BS.  You know, they have more rights than you or I.

As for trying to fight it, the Town can write any Ordinance and enforce it.  You would either have to be willing to take a ticket or get arrested, get an attorney, fight it, lose it, appeal it and hope the State sees your point.  Might be worth it...probably not.  You could sue the individual town too, but again, lots of costs involved!

They know they got you, so they don't care rgmn!
