So whats the sense in buying a New York license if you can't transport your catch in your boat??
this is freakin stupid
The season is open in NEW YORK
Plus these stupid cops can't tell the difference between black fish and black sea bass with the skin on let alone determin a species of a filleted hunk of fish
the way I see It the only thing these guys did wrong is have a fillet fish on board

The officers did the right thing. There is no way to prove if the fluke were caught in NJ or NY waters. Since they pulled their boat on a NJ ramp they were illegally possesing fluke in NJ.

They could have easily launched a 19' boat over in Great Kills on Staten Island and keep the fluke (provided they met NY state minimum size fluke regulations).

What difference does it make if you drive over the bridge or ride over the water ????Like I said STUPID and what happened to being Innocent till proven guilty. Seems to me everyones conditioned already to not having any RIGHTS or not being able to QUESTION any thing

I am sure not innocent till proven guilty is a factor at the moment.  I am sure a cout date will decide the innocence or guilt of this group.  For the time being, they got a fine and all their gear got confiscated. It is like anyone who breaks the law.  The first action is to fix what looks wrong, then all the technical stuff comes later.

You do not get a fine on the water, at the dock, at the ramp. You will only get a fine in court or if you plead guilty and you will THEN pay a fine.

A LEO can not fine you, they can only give you a summons. You will then appear in court or plead out.

As far as taking your gear, they will do that to hold as evidence. The LEO has no power to keep it permanently, only to hold for evidence. What eventually  happend to the gear will also be decided by the court.
