For the tree owner (or Tree owners insurance company) to be liable for the tree the insurance company would have to prove neglect on the tree owners part. Very hard to do.

whs Got a tree next door that looks like it will fall on your yard, House, car, take a photo of it.
to prove neglect. notify that neighbor and give them a photo Copy.
I am watching this play out on both sides of Me Now.
I am in no danger but one pine tree 20 ft fell on my Lot from next door. I cut it up he put it out for pick up. Friendship saved.  slt

Yes.. the responsibility of the tree is  the homeowner in which it fell on.  Its up to that persons insurance company to choose to or not to go after the other persons company

Registered letter is the best way....Plus having a report from an arborist would be the way to go.

During a storm back in the spring one of my neighbors trees became uprooted and almost fell over. It was ready to go at anytime, with my house and boat, which I promptly moved, directly in its path. He did the right thing and had it removed before it became an issue.  clp
