I know we can't all just climb around putting up American Flags where we feel like...but not sure dude should have gone to jail for it.....
Tell me what the charges of arrest were.....Tresspassing on private property that is partially submerged in the ocean?
Was it posted as Private Property around the coaster out there?
If the state is going arrest people over it, they really should mark it off with the white security bouys....or get it out of the water.....we all know what type of attention it will draw when the boats start to go back in the water come spring.....everyone will want to pull up to it and get that Kodak Moment standing on that thing.

My opinion of this may not be popular but here it goes...Attention whores like this who use emergency resources and personel so they can get on the news really Pee me off. I think him and any other narsisistic jackwagon that does something like this should be punished severly with jail time and LOTS of community service.

He did it to draw attention to himself. There are plenty of ways to draw attention and actually help people.

I have some mixed up feelings about this one.
The roller ride has been there for 9 weeks now,so he decides to place a flag on it. He did not BURN the flag,he did not hurt any one.Certainly they waited for him to come down before they arrested him.Is he stupid ? Maybe. Or does he show the American way to get up and continue to get through it all.  Id rather see the flag and "let it go" at that.

It's abandoned property out in OUR state waters, so he stood atop and raised a flag. Does this mean if I dive a wreck out on the Axel Carlson and stand.on it, the.police dive team is going to dive down there to get me? I can't swim with handcuffs on.   He is only the first, there will be more. Will they take it down? I don't thnk so, its a New out of towner attraction. I'll bet they remove some of the staircase to keep people from future climbs, but keep the rest standing with a possible slow removal effort as a tourist attraction.
I've spent most of my life fishing, the rest I've just wasted     <'((((><

I believe he was charge with disorderly conduct. Here is the (NJ) definition of 'disorderly conduct':

2C:33-2. Disorderly conduct

a. Improper behavior. A person is guilty of a petty disorderly persons offense, if with purpose to cause public inconvenience, annoyance or alarm, or recklessly creating a risk thereof he

(1) Engages in fighting or threatening, or in violent or tumultuous behavior; or

(2) Creates a hazardous or physically dangerous condition by any act which serves no legitimate purpose of the actor.

b. Offensive language. A person is guilty of a petty disorderly persons offense if, in a public place, and with purpose to offend the sensibilities of a hearer or in reckless disregard of the probability of so doing, he addresses unreasonably loud and offensively coarse or abusive language, given the circumstances of the person present and the setting of the utterance, to any person present.

"Public" means affecting or likely to affect persons in a place to which the public or a substantial group has access; among the places included are highways, transport facilities, schools, prisons, apartment houses, places of business or amusement, or any neighborhood.




Seems to fit the actions of this individual. It would fall under 2C:32.a(2) (in bold print by me)


The offense he was charged with is a petty disorderly person (PDP) offense. He is on the hook for up to 6 months in jail and a fine of up to $500 for a petty disorderly persons offense. MOST PDP offensers do not get jail time.


From what I have read about this incident the actor was wearing a back pack and climbed aboard the roller coaster and began climbing to the top. At that point, his intentions were not known by anyone but him. Thus the need for a somewhat heavy police presence.

Where exactly did he trespass? give me a freakin break.  if we could charge him with stupidity so be it, but we can't.  Disorderly conduct, i think that is a stretch as well.  if there are no trespass signs or keep off state property, etc. on it than yes charge him, but i don't think there are.

guess i'm an idiot but I like the american flag up there....especially if we are going to use this as a reminder/landmark for all to see.
