Legal Fluke Question?

With all of these NY/NJ regulations of size limit.. What if you kept all fish alive in your live well.. Now if you port in NJ waters an happened to drift into NY waters with 18" fluke in your live well, will you get fined or will the CG just have you release the fish that are not NY keepers since they will be released alive and healthy....

As I recall it is posession of undersize fish whether alive or dead that is the problem.

If you're stopped in NY waters while fishing or seen fishing there, regardles if the fish is alive or dead, it's in your possession and must be a legal NY fish.

While maybe on an off chance you'll find a NY DEC officer that just won the lottery and will be in a good mood, more than likely you're gonna get a fine and they'll probably take/release the fish as well.

The authorities have a lot of discretion whether to write or not. As Gottog said, depends on the mood, etc. A lot depends on the circumstances.

But, be prepared to be written up.

Any undersize fish on the boat is in violation.....it is the officers discretion whether to write you or not.......but from what I have heard not to many have been warned 5hrug

Fishing and boating is one of the better stress relivers that I know. Where else can you meet so many people on the water, eg: coast guard, state police, dep, fish and game,epa ?????  rgmn

When I had my tackle shop we had a large mouth bass in a tank and we had ex wardens that would hang out in the shop. They told us we would need a permit for an under size fish in the tank.
Fishing Sandy Hook and anywhere I can get on a boat.




My biggest fear is when I die my wife sells all of my fishing tackle for what she thinks I paid for it!

I was approach by a co last year prior to cleaning my fish at the dock.  As I pulled one out I said.  This one was right on the money  I hope I don't get a fine because it shrunk a 1/4" from being cold...
he said.  Actually it's the opposite.. they grow.  and sure enough it was more that over. I'd say 1/4".  probably their meat/muscle relaxes after death.  who knows.

My father and uncle were in Raratin bay last week, they got boarded by a fedral game warden. He did not check saftey equipment just fish, they had two fluke in the live well, one was 18 and a half and the other was 23 inches. They came on checked the fish and left with no problems.But.... they ran into a friend of theirs out on the water who was also boarded, and his boarding didnt go as well. He had 4 fluke, the smallest one measured 18 inches and they made him release it.He tried to argue it, pleading that it was 18 inches and it was. This warden didnt want to hear it. So after being told a few times and back and fourth arguing he released the fish.He was told he was lucky it was in the live well. I wasnt there I was just told what happened. I think the person with out mentioning names owns a marina in that area,and is the nicest guy you could meet. So I'm sure the fish was 18 inches, and this really happened. 18 inches is 18 inches, its pretty messed up that this happened.

As far as I know it's Illegal to keep any Native species of any kind in captivity unless you can prove they were purchased out of state and you have the paperwork. Then you can apply to the state for a permit. I have 3 Pine Snakes here that were bought in Cali and shipped here and registered with the state. t^

Spoke to one of the Wardens when I saw him in Highlands and he was telling the guys some of the coolers with measurments on the top of the cooler are coming up short (the measurements are not accurate). He suggested to use a regular board with a tape attached and a block of wood up front were the nose or mouth goes.
All this stuff can get out of hand.Who's to say
Maybe they should give THEIR rulers to everone.
I can just see that! Where does it end.
A  measurement taken with the tape you have SHOULD DO IT.(I think I know what I'm trying to say).
